Terms and Conditions – Translation Services

1. Introduction

These Terms and Conditions apply to all translation, proofreading, and post-editing services provided by Camille SUDRE (hereinafter referred to as "the Service Provider") via the website camillesudre.com or any other communication channel. By confirming an order, the Client unconditionally accepts these Terms and Conditions, which take precedence over any other terms unless expressly agreed otherwise in writing.

The services provided by the Service Provider include, but are not limited to: document translation, translation revision, website localisation, and post-editing. The working source languages are German and English, with French as the target language. The Service Provider guarantees professional services carried out by a qualified translator with subject-matter expertise.

4. Ordering Services

To place an order, the Client must fill out the quote request form or online order form, specifying the documents to be translated, the type of service required, the source and target languages, and any other relevant details. Upon receiving the request, the Service Provider will issue a detailed quote, indicating the price and turnaround time. The order is deemed confirmed once the Client returns the signed quote with the words "Agreed and accepted".

5. Pricing and Payment Terms

Service prices are based on word count, service type, language combination, and text complexity. The quote provided is firm and final unless substantial changes are made to the original brief during the project.
Payment is typically made by bank transfer and is due within 15 days of the invoice date, unless otherwise agreed. For first-time or high-volume orders, an advance payment or deposit may be required.

6. Delivery

Delivery times are specified in the quote and are based on project volume, service type, and complexity. The Service Provider will make every effort to meet these deadlines, except in cases of force majeure or substantial changes requested by the Client. In case of delay, the Client will be informed and a mutually acceptable solution may be discussed.

7. Confidentiality and Data Protection

The Service Provider treats all Client information and documents with strict confidentiality. No data will be shared with third parties without prior consent, except when legally required.
In accordance with applicable legislation (e.g. GDPR for EU Clients), Clients have the right to access, correct, or delete their personal data.

8. Revisions and Modifications

Clients have up to 7 days after delivery to report any errors or inconsistencies. Revisions will be made free of charge if the request aligns with the original order terms.
Any request involving additional work will be subject to an extra charge, with the Client’s prior approval.

9. Right of Withdrawal

Under Article L121-21-8 of the French Consumer Code, the Client has no right of withdrawal once the service has begun, as work starts immediately upon quote acceptance and at the Client’s express request.

However, if the Service Provider has not yet started the service, the Client may cancel the order at no cost.

10. Liability

The Service Provider commits to delivering high-quality services but cannot be held liable for errors or omissions resulting from inaccurate information provided by the Client.
Nor shall the Service Provider be held liable for the Client’s use or interpretation of the translated material. Liability is limited to the amount paid for the service, provided the damage does not exceed this amount.

11. Intellectual Property

Translations remain the intellectual property of the Service Provider until full payment is received. Upon payment, copyright is transferred to the Client, unless otherwise specified in the quote. However, the Service Provider reserves the right to reference the service for commercial or promotional purposes.

12. Force Majeure

In cases of force majeure (natural disasters, strikes, civil unrest, IT system failures, etc.), the Service Provider shall not be liable for delays or failure to deliver services.

13. Disputes and Applicable Law

These Terms and Conditions are governed by French law. In the event of a dispute, the parties shall first attempt to reach an amicable resolution. Failing that, the matter will be referred to the competent courts of Colmar, France.

14. Amendments to the Terms and Conditions

The Service Provider reserves the right to amend these Terms and Conditions at any time. The updated version will be published on the website and shall apply immediately to all new orders.

In the event of any discrepancy or inconsistency between the English and French versions of these Terms and Conditions, only the French version shall be legally binding.
